By downloading, installing, or using our apps — Page Surfer, SynKitPro, or DupliKit — or visiting parakeetsoftware.com, you agree to be bound by these terms.

You must be at least 13 years of age to use our Service. By using the Service, you represent and warrant that you meet this requirement.
You may use our apps for personal, non-commercial purposes in accordance with these Terms. You agree not to:
All content, design, code, graphics, logos, and other materials within the Service are the exclusive property of Parakeet Software LLC and are protected by applicable copyright, trademark, and intellectual property laws.
Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.
Our apps are distributed through Apple's App Store and Mac App Store. Your use of our apps is also subject to Apple's Terms and Conditions. We are solely responsible for our apps and their content, not Apple.
Some of our apps offer paid features, subscriptions, or one-time purchases. All transactions are processed by Apple through the App Store. We do not store payment information.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID account settings.
Refunds are handled by Apple in accordance with their refund policy.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Parakeet Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you exceed the amount you paid us in the twelve months preceding the claim, or 0 USD, whichever is greater.
While DupliKit and SynKitPro are designed with care to protect your files, you are solely responsible for maintaining adequate backups of your data. We strongly recommend backing up important files before using any file management or synchronization tool. We are not liable for any data loss that occurs from use of our apps.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
